Note: Settlement Certificates that were issued in this case in June 2013 expire on December 21, 2015.

Update (June 2013): As a result of the appeal that delayed class members' receipt of the benefits of the settlement, the parties have agreed to an amendment (which can be downloaded here) which increases the relief to class members.  The settlement certificates that will be issued to class members will have a face value of $1,610 (instead of $1,450), and class members who choose the cash option will receive $555 (instead of $500).  Settlement certificates are scheduled to be mailed on June 20, 2013.  If you have any questions, please contact Class Counsel.

Update (February 2013): On February 7, 2013, the Maryland Court of Special Appeals issued an opinion dismissing Pohanka's appeal.  A copy of the opinion is available on the Court Documents page.  If you have questions about the Court's opinion, please contact Class Counsel.

Update (April 2012): At the Final Approval Hearing held in the Circuit Court for Montgomery County on April 13, 2012, the Court granted final approval to the settlement in the case.  However, Pohanka filed a notice of appeal, and the Court has temporarily stayed enforcement of the order approving the settlement.  If you would like more information, please contact Class Counsel. This website contains information about a proposed settlement in McNab, et al. v. Pohanka Auto North, Inc., et al., Case No. 349467V, a class action which was filed on July 5, 2011, in the Circuit Court for Montgomery County, Maryland.

In the McNab lawsuit, among other claims, the Plaintiff alleged that Pohanka dealerships in Maryland sold consumers vehicles that had previously been repossessed without providing proper disclosure.

The parties reached a settlement on September 29, 2011.  The settlement requires approval by the Court.  The Court has scheduled a Final Approval Hearing for April 13, 2012 at 1:30 p.m. in the Circuit Court for Montgomery County, Maryland to determine whether the proposed settlement is fair, adequate and reasonable.  The public is free to attend.  However, if you are a Class member you do not need to attend the hearing to receive benefits under the Settlement Agreement.
